ALTERNATIVE DISPUTE RESOLUTION
Alternative dispute resolution (ADR), is a legal technique for the resolution of disputes outside the courts, wherein the disputants themselves get to select one or more persons who serves as arbitrator.
In UAE, Arbitration is most commonly used for the resolution of commercial disputes, particularly in the context of international commercial transactions. It is more helpful, however, simply to classify Arbitration as a form of binding dispute resolution, equivalent to litigation in the courts, and entirely distinct from the other forms of ADR, such as negotiation, mediation, or determinations by experts, which are usually non-binding.
We serve as both advocates and Arbitrators in arbitration matters. Our ADR practice includes the following areas that come under the umbrella of arbitration.
• Domestic and International Arbitration • Industry arbitration • Contract and license disputes • Commercial disputes • Construction disputes • Other disputes
Contractees may in general stipulate in the main contract or by a subsequent agreement, to submit a dispute arising between the concerning the implementation of a specific contract to one arbitrator or more. Agreement may also be reached for arbitration in a specific dispute with particular conditions. An agreement for arbitration shall only be evidenced in writing.
